This English version is a translation provided for your convenience. The Dutch version of these terms and policies is legally binding; in the event of any discrepancy, the Dutch text prevails.

Terms & Conditions

In short

  • By paying or booking, you agree to these terms.
  • Treatments: 50% deposit on booking, the remainder after the treatment in the studio.
  • Free cancellation up to 24 hours before the start of the appointment. After that the deposit is forfeited.
  • Online courses are non-refundable; you get immediate access.
  • Minimum age is 15.

By making a (deposit) payment or completing an order, you automatically agree to these terms and conditions. Please read them carefully before booking or purchasing.

Studio address: De Overmaat 26, 6831 AH Arnhem — the location where Chiva holds her appointments: treatments, personal training tracks and classes.

Article 1: Definitions
  • LUXIQUE / we: the sole proprietorship (CoC 94764158), operating under the name LUXIQUE.
  • Customer: any natural person who purchases a treatment, course, programme or other offering.
  • Treatment: a lash treatment (new set, refill/fill) by appointment in the studio.
  • Online course: a digital course product accessible online immediately after payment.
  • Personal programme / workshop: guidance or lessons on location on a predetermined date.
Article 2: Applicability

2.1 These terms apply to all offers, bookings, treatments, courses and agreements of LUXIQUE.

2.2 Deviations only apply if agreed in writing.

2.3 By booking, paying or purchasing an online course, the customer declares to have read and accepted these terms.

Article 3: Minimum age

3.1 The minimum age for treatments and participation in courses is 15.

3.2 By booking, a customer under the age of 18 declares that a parent or legal representative has taken note of these terms and has given permission for the booking and the treatment. LUXIQUE may request confirmation of this permission and suspend the treatment until it is obtained.

Article 4: Prices and payment

4.1 A New Lash Set costs €120 and a Fill Lash Set (refill) costs €90. LUXIQUE charges VAT; stated prices include VAT.

Treatments: a deposit of 50% of the treatment price is required at the time of booking. The reservation is only final once the deposit has been received. You pay the remaining amount (the other 50%) on the day of the scheduled appointment, in the studio, immediately after the treatment, by card.

Personal programmes / workshops: a deposit of 20% of the total price is required at the time of booking. You pay the remaining amount no later than before the start of the first lesson day.

Online courses: you pay the full amount in one go at purchase. Immediately after payment you receive access to the course.

4.5 Online payments are processed via our payment provider Stripe (incl. iDEAL, credit card, Apple Pay, Klarna) and/or via the booking system Cal.com. Payments in the studio can also be made by card. Cash is not accepted.

Article 5: Right of withdrawal (exclusion)

5.1 Treatments take place on a specific, predetermined date. As a result, the statutory right of withdrawal for consumers does not apply, in accordance with Article 6:230p(b) of the Dutch Civil Code. Cancellation or rescheduling of treatments is governed exclusively by the treatment rules in Articles 6.1 through 6.3.

5.2 Only when booking a training course or programme online, the student has a statutory cooling-off period of 14 days from the time of booking. During this period, the student may withdraw from the agreement free of charge and all amounts already paid, including the deposit, will be refunded in full. Paying a deposit does not waive the cooling-off period.

5.3 If the training course or programme begins within the 14-day cooling-off period at the student's express request, the student may be required to pay a proportionate amount for the part already performed.

5.4 For online courses supplied as digital content that becomes fully accessible immediately after purchase, the student expressly consents to immediate delivery in advance and acknowledges that the right of withdrawal ends once access has been granted.

Article 6: Cancelling and rescheduling
Treatments

6.1 Up to no later than 24 hours before the start (start time) of the appointment, you can cancel or reschedule free of charge. In that case the deposit is refunded within 14 days, or, when rescheduling, offset against the new appointment. What is decisive is the moment your cancellation or rescheduling request demonstrably reaches us via the customer portal, by email (info@luxique.nl) or via Instagram (@lashedbychiva).

6.2 In the event of cancellation, rescheduling or no-show within 24 hours before the start of the appointment, the deposit is forfeited and there is no right to a refund or offset. In that case the deposit serves as compensation for the time reserved exclusively for you and the preparation already carried out. This also applies when the impediment arises through no fault of your own, such as, but not limited to, car trouble, delay or failure of public transport, lack of transport, or a sick family member.

6.3 If you arrive more than 20 minutes after the agreed start time, the treatment can no longer be fully performed, the appointment lapses and the deposit is forfeited. In that case LUXIQUE may, at its own discretion, still perform a shortened treatment within the remaining time; this is not a right of the customer and gives no right to a (partial) refund.

Personal programmes / workshops / on-location courses

6.4 Cancellation after the cooling-off period: after the statutory cooling-off period has ended, the student may cancel the training course or programme. Upon cancellation, 20% of the total course price is charged as a cancellation fee. The 20% deposit already paid is then treated as this cancellation fee and is not refunded. Any amounts paid above this 20% will be refunded to the student in full.

6.5 Purpose of the cancellation fee: this cancellation fee covers the costs incurred by LUXIQUE / Lashed by Chiva as soon as a course place is reserved, including holding one of a limited number of places, preparing and scheduling the training course, and committing staff and materials.

6.6 Cancellation by LUXIQUE: if LUXIQUE / Lashed by Chiva cancels or reschedules the training course, the student is entitled, at their choice, to a full refund of all amounts paid, including the deposit, or to transfer to another date free of charge.

Online courses

6.8 Online courses are non-refundable. Immediately after payment you receive full access to the digital course material (see Article 5.4).

Article 7: Illness

7.1 In the event of illness of the customer within 24 hours before the start of a treatment, the deposit is forfeited, in accordance with Article 6.2. Up to no later than 24 hours before the start, you may reschedule the appointment free of charge if you wish (see Article 6.1).

7.2 In the event of illness during a multi-day programme or course, the scheduled days remain reserved; there is no right to a refund or rescheduling. A course of, for example, three days cannot be interrupted on the last day with a claim to a new appointment. Illness is at the customer's own risk.

Article 8: Result, retention and warranty

8.1 Immediately after the treatment, the customer has the opportunity to assess the result in the mirror. Any comments about the result must be reported at that moment, immediately after the lashes have been applied. Reporting afterwards that you are not satisfied with the result gives no right to repair, refund or compensation.

8.2 If more than 20% of the applied lashes fall out within 3 days (72 hours) after the treatment, you may claim a one-time free correction, provided that you: (a) report this within those 72 hours via info@luxique.nl; (b) have not visited a sauna, steam room or tanning bed during that period; (c) have not exercised intensively; and (d) have not swum in salt sea water or chlorinated water. The correction is scheduled by mutual agreement, depending on availability.

8.3 Apart from the case mentioned in 8.2, no warranty is given on the natural shedding of lashes; shedding is a normal and natural process.

Article 9: Allergic reactions and liability

9.1 The customer is obliged to report known allergies, hypersensitivities and eye or skin conditions before the treatment. LUXIQUE is not liable for allergic reactions, skin irritations or eye complaints that arise after a treatment, except in the case of intent or deliberate recklessness on the part of LUXIQUE.

9.2 In the event of an allergic reaction, there is no right to a refund. If there is room in the schedule, a free removal of the lashes can be requested.

9.3 Furthermore, LUXIQUE is not liable for indirect damage, consequential damage or lost income, nor for damage caused by incorrect or incomplete information provided by the customer.

9.4 The liability of LUXIQUE is, except in the case of intent or deliberate recklessness and except for mandatory statutory provisions, at all times limited to the invoice amount of the relevant service.

Article 10: Participant's own responsibility

10.1 The participant is responsible for sufficient eyesight (the ability to see fine hairs), physical capacity (back, posture, concentration during the lesson day) and suitability for the profession.

10.2 If it turns out afterwards that this is not adequate, there is no right to a refund.

10.3 The participant can book a trial session in advance (approx. 1 hour, € 30) to test eyesight and skill. If the participant does not make use of this, participation is entirely at their own risk and there is no right to compensation afterwards.

Article 11: Models

11.1 The participant arranges their own models for the practical lessons and is informed of the requirements in advance.

11.2 The absence of a model is entirely at the expense and risk of the participant; without a model there is no practical exercise that day.

11.3 Insufficient practice may result in not obtaining the certificate. The absence of a model gives no right to a refund.

Article 12: Certification and quality

12.1 For online courses, you receive a certificate of participation after completion. This confirms that you have gone through the theory and course material; it is not a guarantee that the techniques are mastered at a professional level.

12.2 For on-location programmes, a certificate is issued only when the technique is sufficiently mastered and the quality meets the set standard.

12.3 In the event of insufficient results, no certificate is issued; the participant does retain full access to the knowledge and materials. Additional lesson days or an exam day can be booked at extra cost.

Article 13: Lateness and attendance

13.1 For treatments, the appointment lapses after arriving 20 minutes late and the deposit is due/forfeited (see Article 6.3).

13.2 For courses, lateness comes off your own lesson time; extension is not possible.

Article 14: Complaints

14.1 Complaints about a treatment must be submitted in writing within 72 hours after the appointment via info@luxique.nl or via Instagram (@lashedbychiva). After 72 hours the possibility to submit a complaint lapses.

14.2 Complaints about a course day must be submitted in writing within 7 days.

14.3 A complaint cannot be processed if it relates to:

  • dissatisfaction with the result that was not reported immediately after the treatment, during the mirror moment (see Article 8.1);
  • the claim that a course was "not worth the money";
  • not being able to complete a multi-day programme due to illness (see Article 7.2).

14.4 LUXIQUE strives to handle valid complaints within 5 working days and to offer a suitable solution by mutual agreement. Submitting a complaint does not affect the customer's statutory rights.

Article 15: Privacy

15.1 LUXIQUE processes personal data in accordance with the GDPR and solely for the performance of the agreement, administration and, with consent, marketing. See the privacy statement.

Article 16: Applicable law

16.1 These terms are governed exclusively by Dutch law.

16.2 Disputes are submitted to the competent court in the district of LUXIQUE's place of business, unless the law mandatorily designates another court.

16.3 If a provision of these terms is null or voidable, the remaining provisions remain fully in force. The relevant provision is replaced by a valid provision that approximates its purpose and intent as closely as possible.

16.4 LUXIQUE may amend these terms. The terms that applied at the time of booking or purchase always apply to a booking or purchase.

Privacy Statement

In accordance with the General Data Protection Regulation (GDPR)

In short

  • We only process what is necessary to carry out your booking and treatment.
  • Payment data goes through Stripe. We do not store card details ourselves.
  • We never sell your data to third parties.
  • You may always view, correct or have your data deleted.

LUXIQUE (hereinafter: "we") respects your privacy and processes personal data in accordance with the GDPR. This statement explains which data we process, why and for how long.

1. Data controller

2. Which data we process

Depending on the service, we process:

  • name;
  • email address;
  • phone number;
  • address / place of residence;
  • payment data (processed via Stripe; we do not store card details ourselves);
  • photos (for example before/after or to assess an eye shape, solely with your consent);
  • data about your website use (via cookies and statistics, see the cookie statement).

3. Why we process this data

  • to carry out your booking, treatment or course;
  • for our administration and invoicing;
  • to communicate with you about your appointment or course;
  • with your consent: to send a newsletter or offers;
  • to improve our website and services.

4. Legal bases

We process data on the basis of: the performance of the agreement, a legal obligation (such as the tax retention obligation), your consent (marketing, photos) and/or our legitimate interest.

5. Marketing

With your consent, we use your email address for a newsletter or offers. You can unsubscribe at any time via the unsubscribe link in every email or by sending a message to info@luxique.nl.

6. Retention period

We do not retain personal data longer than necessary. As a rule, we retain customer data up to 2 years after the last contact. For invoices and financial administration, the statutory tax retention obligation of 7 years applies; for that data, the 7-year period takes precedence over the 2-year period.

7. Sharing with third parties (processors)

We share data solely with parties necessary for our services, on the basis of processing agreements:

  • Stripe: payment processing; —
  • Cal.com: appointment scheduling and bookings; —
  • Supabase: accounts and data storage; —
  • Mux: video hosting for the courses; —
  • Vercel: hosting of the website; —
  • Anthropic: the AI chatbot on the website; —
  • mijndomein: domain and email. —

We never sell your data to third parties.

8. Cookies and statistics

Our website uses cookies and Vercel Analytics to measure usage, and possibly a Meta Pixel for advertising. See the cookie statement.

9. Your rights

You have the right to view, correct, have deleted, restrict the processing of, object to and transfer your data. To do so, send a request to info@luxique.nl. You also have the right to lodge a complaint with the Dutch Data Protection Authority.

We take appropriate technical and organisational measures to protect your data.

Cancellation Policy

In short

  • Treatments: free cancellation up to 24 hours before the start, after that the deposit is forfeited.
  • More than 20 minutes late after the start time → the appointment and the deposit lapse.
  • Online courses are non-refundable.
  • Training courses/programmes: a 14-day statutory cooling-off period; after that, cancellation carries a fee of 20% of the course price.

Online courses

  • No refund. Immediately after payment you receive full access to the digital course material and thereby waive the right of withdrawal.

Treatments

  • 50% deposit on booking; you pay the remaining amount on the day of the appointment, in the studio, immediately after the treatment (by card).
  • Free cancellation or rescheduling up to no later than 24 hours before the start of the appointment. Deposit refunded or offset.

  • Shedding of more than 20% of the lashes within 3 days → one-time free correction, provided it is reported in time and no sauna, intensive exercise or salt/chlorinated water.
  • Allergic reaction → no refund; free removal possible if the schedule allows.
